1. Introduction

These Terms of Service ("Terms") govern (i) the relationship between you ("Student" or "you") and Daniel Faber ("Tutor") regarding tutoring services provided through this website and (ii) your use of this website. These Terms constitute a legally binding agreement between the Student and the Tutor.

2. Acceptance of Terms

By accessing and using this website, you agree:

(i) to be bound by these terms and conditions which may be amended by the Tutor from time to time without notice;

(ii) each visit to this site constitutes your acceptance of the current terms of service; and

(iii) content (without exception) is provided without guarantee and may be modified without notice.

You also agree to be bound by all applicable laws and regulations of the Emirate of Dubai and, to the extent applicable in the Emirate of Dubai, the Federal Laws of the United Arab Emirates (together, "UAE Law").

3. Use of Website

You agree to use this website for lawful purposes only and in a manner consistent with UAE Law.

4. Services

4.1 Appointment Format

All appointments will be conducted online by default. In-person appointments are available only upon specific request by contacting the Tutor directly. The Tutor reserves the right to set different hourly rates and charge for incidental expenses for in-person appointments.

4.2 Educational Nature of Services

The Tutor provides educational services only and not legal services. Any information provided during tutoring sessions is for educational purposes only and should not be construed as legal advice. Students seeking legal advice should consult with qualified legal professionals.

5. Booking and Cancellation

5.1 Booking Requirements

(i) the minimum notice period for booking an appointment is 8 hours;

(ii) payment must be made in full at the time of booking; and

(iii) upon booking confirmation, the Student and Tutor enter into a contract governed by these Terms.

5.2 Cancellation Policy

(i) the minimum cancellation notice period required is 8 hours before an appointment;

(ii) cancellations must be made through the website only;

(iii) the Tutor may cancel appointments at any time before the appointment time, in which case the appointment will be refunded or rescheduled; and

(iv) refunds for cancellations due to extenuating circumstances may be granted at the Tutor's sole discretion.

6. Session Packages

6.1 Validity Periods

(i)10 Session Deal: Must be used within 90 days of purchase;

(ii) 5 Session Deal: Must be used within 60 days of purchase; and

(iii) 3 Session Deal: Must be used within 30 days of purchase,

Any unused sessions will expire after the respective validity period.

7. Payments and Refunds

All payments and refunds will be processed through PayPal in accordance with PayPal's terms of service, in addition to these Terms.

8. Disclaimers and Limitations of Liability

8.1 Performance Disclaimer

While the Tutor will use best endeavours to provide quality educational services, the Tutor cannot guarantee the academic or professional success of any student.

8.2 Limitation of Liability

In no event (including the Tutor's negligence) will the Tutor be liable for any:

(i) economic losses (including, without limitation, loss of revenues, profits, contracts, business or anticipated savings);

(ii) loss of goodwill or reputation;

(iii) special, indirect or consequential losses; or

(iv) damage to or loss of data (even if the Tutor has been advised of the possibility of such losses),

the Student will indemnify the Tutor against all claims and liabilities directly or indirectly related to the Student's use of the website, the Tutor's services and/or breach of these Terms of Service.

9. Entire Agreement

These Terms constitute the entire agreement between the parties with respect to their subject matter and supersede any previous communications or agreements. The parties both acknowledge that there have been no misrepresentations and that neither has relied on any pre-contractual statements.

10. Governing Law

These Terms shall be governed by and construed in accordance with UAE Law.
